Welcome to quotemyhealthplans.com (the "Website"), a website owned and operated by Connectnow LLC (the "Company," "we," "us," or "our"). To help you use the Website and to explain the relationship that arises from your use of it, we have created these Terms of Service ("Terms of Service," "Terms") and a separate Privacy Policy. Our Privacy Policy explains how we treat information we hold about you, including personal information, and these Terms govern your use of the Website and your participation in the services offered through it (the "Services").

These Terms contain a binding arbitration agreement. By using the Services or otherwise accessing the Website, you agree to be bound by all of these Terms and by all policies and guidelines incorporated into them by reference, including our Privacy Policy and our Disclosures & Licensing page. The Services are provided to you subject to these Terms and to any amendments, operating rules or policies we may publish from time to time, all of which are included here by reference.

3. What this Website is

The Website is an advertising and referral service. We are an independent insurance agency, and we are not an insurance carrier. We do not sell insurance, we do not bind coverage, and we do not issue policies. When you submit a request, we connect you with licensed insurance agents and agencies who can discuss plan options with you. We are not a government agency, we are not affiliated with HealthCare.gov or with any federal or state government agency, and we do not provide government services or determine eligibility for government programs.

Nothing on the Website is an offer of insurance, a quote that binds a carrier, a guarantee of coverage, a guarantee of any price, premium or savings, or a determination of your eligibility for coverage or for a premium tax credit or subsidy. Coverage exists only when a carrier issues a policy and you pay the required premium. Plan availability, benefits, provider networks and pricing vary by state, carrier and individual circumstances, and not all plans are available in all states.

We do not provide legal, tax, accounting or medical advice, and nothing on the Website should be relied on as such advice. Information on the Website is general in nature and may not reflect the rules of your state or your individual situation.

4. Modification of these Terms and of the Services

We reserve the right to change, add to or remove any of the terms, conditions and notices under which the Services are offered. You are responsible for reviewing these Terms regularly, including any changes we make, which will be reflected in the "Last updated" date above. Your continued use of the Services means you agree to all such terms, conditions and notices. We also reserve the right to modify or discontinue the Services, in whole or in part, temporarily or permanently, at any time with or without notice, and you agree that we will not be liable to you or to any third party for any modification or discontinuation of the Services.

By submitting a form on the Website, you agree to be contacted by Quote My Health Plans and by participating licensed insurance agents and agencies at the telephone number and email address you provide, including by calls and text messages placed using an automatic telephone dialing system, an artificial or prerecorded voice, or AI-assisted or AI-generated communications, about health insurance plans and related products. Consent is not a condition of purchasing any goods or services.

You can revoke consent at any time by replying STOP to a text message, by telling an agent to stop calling, by asking to be placed on our internal do-not-call list, or by emailing privacy@quotemyhealthplans.com. Message and data rates may apply, and message frequency varies. You represent that each telephone number you provide is yours and that you are permitted to receive calls, texts and other communications at it.

Calls with us, and with the agents and agencies we work with, may be recorded or monitored for quality assurance, training, compliance and record-keeping purposes.

6. No obligation, and how we are compensated

Using the Website is free. You are never obligated to purchase anything, and we do not charge you for connecting you with a licensed agent. We are compensated by carriers, agents or agencies when coverage is placed.

7. User conduct and usage obligations

The Website may include online means designed to let you communicate with us. You agree to use those tools only to send and receive messages and material that are proper, and you agree not to use the Services for any unlawful or commercial purpose of your own. As a condition of using the Services, you agree to provide true, accurate, current and complete information about yourself, and to keep that information accurate and up to date. If you provide information that is untrue, inaccurate, not current or incomplete, we have the right to terminate your access and to refuse any current or future use of the Services.

You also agree that you will not use the Services to:

• Obstruct or hinder any other user's use and enjoyment of the Services;
• Violate any applicable local, state, national or international law or regulation;
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity;

Because we have no control over those sites and resources, you acknowledge and agree that we are not responsible for their availability and do not endorse, and are not responsible or liable for, any content, information, advertising, products or other materials on or available from them. You further acknowledge and agree that we are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services.

Insurance carriers, licensed agents and agencies we work with are independent businesses. Their statements, recommendations, products and conduct are their own, their own terms and privacy policies govern your relationship with them, and we are not responsible for them.

11. Proprietary rights

The Website, including its text, design, graphics, logos and code, is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws. You acknowledge and agree that the Services contain proprietary and confidential information that may be protected by applicable laws, and that content presented to you through the Services is protected by copyrights, trademarks, service marks, patents or other proprietary rights. Except as expressly authorized by us, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Services, in whole or in part.

Carrier names, logos and service marks referenced on the Website belong to their respective owners and are used for identification purposes only. Nothing on the Website grants you a license to use our trademarks or those of any third party.

Our total liability for any claim relating to the Website or the Services will not exceed one hundred U.S. dollars ($100). 16. Dispute resolution, arbitration and governing law

These Terms are governed by the laws of the state in which Connectnow LLC is headquartered, without regard to conflict-of-law principles. Before filing any claim, you agree to contact us and to give us thirty (30) days to resolve the issue informally.

Any dispute that is not resolved informally will be resolved by binding individual arbitration. You and we agree to waive the right to a jury trial and the right to participate in a class, collective or representative action. The arbitration will be conducted by a recognized arbitration provider under its consumer rules, and any award will be limited to the relief available in an individual action. You may opt out of this arbitration agreement by emailing privacy@quotemyhealthplans.com within thirty (30) days after you first use the Website, and if you do, disputes will be resolved in court as otherwise permitted by law. Nothing in this section prevents either party from seeking relief in small claims court, or from filing a complaint with a government agency.

If any part of this arbitration agreement is found unenforceable, the rest of it will remain in effect, except that if the class action waiver is found unenforceable, then this entire arbitration agreement will be void.

17. Termination

We reserve the right to terminate your access to any or all of the Services, at any time, without notice, for any reason, including if we believe you have violated these Terms. If your access is terminated, the provisions of these Terms that by their nature should survive will survive, including Sections 8, 11 and 13 through 19.

18. Changes, severability and entire agreement

We may update these Terms at any time, and the "Last updated" date above shows when they changed. Continued use of the Website means you accept the updated Terms. If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full effect. These Terms, together with our Privacy Policy and our Disclosures & Licensing page, are the entire agreement between us concerning the Website, and supersede any prior agreement on that subject.
